To ensure the highest quality action photos, we limit the number of athletes we photograph per event/heat. If we exceed our capacity for your event then you’ll be notified ASAP (via phone/text at the number you provided with your order) to select a different event or we’ll issue you a refund for that item.
Due to the nature of high-paced event photography and the limitations imposed on us by the organizer, officials, etc we cannot accept special photography requests.
In the rare event that we do not capture any photos for your athlete then we will issue a refund for that specific item.
David Cervenka Photography (Photographer) maintains full intellectual property rights to all images produced during the photography session. Client shall have no right to sell proofs or final images or use images for marketing unless express written approval is provided by Photographer.
Photography Services Online Signup Release Form
I, [As Name Stated on Order], hereby consent to and authorize David Cervenka Photography ("Photographer"), its employees, contractors, and agents to use, reproduce, and publish photographs taken during the photography session for any lawful purpose, including but not limited to marketing, advertising, display, and promotion of David Cervenka Photography services, both online and offline.
I understand and agree to the following terms:
- Consent to Photography: I acknowledge that I am participating voluntarily in a photography session and I grant the Photographer permission to capture my likeness and any accompanying family members or participants during the session.
- Ownership and Copyright: I understand and agree that all rights to the photographs, including ownership and copyright, belong to the Photographer. I have no rights to the photographs, and I shall not receive any financial or other compensation for the use or publication of these photographs.
- Usage Rights: I grant the Photographer the right to use, publish, and display the photographs in any media format, including but not limited to websites, social media platforms, advertisements, brochures, and promotional materials.
- Model Release: I hereby release the Photographer and their legal representatives, successors, and assigns from any and all claims, actions, demands, or liabilities arising out of or in connection with the use of the photographs, including but not limited to any claims for invasion of privacy, defamation, or copyright infringement.
- Confidentiality: The Photographer agrees to use reasonable efforts to protect the privacy and confidentiality of any personal information collected during the photography session. However, I understand and acknowledge that no security measures are perfect, and the Photographer cannot guarantee the absolute security of my personal information.
- Right to Refuse Service: The Photographer reserves the right to refuse service to anyone who does not comply with the policies and guidelines set forth by the business.
- Age of Consent: If the participant is under the age of 18, I hereby confirm that I am the parent or legal guardian of the minor and have the legal authority to consent to the terms of this release on their behalf.
By completing this order, I acknowledge that I have read and understand the terms of this release form, and I voluntarily agree to its contents.
